These Terms of Service ("Terms") govern your access to and use of services provided by Brain and Memory Clinic ("we", "us", "our"). By engaging our services, booking appointments, or enrolling in our programs, you agree to be bound by these Terms.
1. Nature of Services
Brain and Memory Clinic provides education, coaching, lifestyle optimisation, cognitive health support, and care coordination services based on evidence-informed frameworks, including the PreCODE® and ReCODE® protocols developed by Apollo Health.
Our services: - Focus on cognitive optimisation, prevention, and support - Are not medical diagnosis or treatment - Do not replace care provided by your GP, neurologist, or other medical practitioners
No services provided constitute medical advice, diagnosis, or treatment under Australian law.
2. Scope of Practice
Services are delivered within the professional scope of practice of: - A Registered Nurse (Australia),and - A Certified ReCODE® 2.0 Practitioner
We do not: - Diagnose medical conditions - Prescribe medications - Provide emergency, acute, or specialist medical care. Where appropriate, we may recommend that you seek advice from your GP or another qualified
healthcare professional.
3. Client Responsibilities
By participating in our services, you agree to: - Provide accurate, complete, and honest information -Complete required questionnaires, assessments, and forms - Take responsibility for completing recommended laboratory or genetic testing (where chosen) - Actively engage in the agreed program
You acknowledge that outcomes depend on individual participation and biological variability, and results cannot be guaranteed.

4. Program Commitment (Pro-Neuro program)
Our services operate on a minimum 12-month commitment, reflecting the long-term nature of cognitive health optimisation.
Key points: - The initial commitment period is 12 consecutive months - Fees are payable monthly or annually, as agreed at enrolment - Early cancellation is not permitted within the first 12 months except where required by law - After the initial 12 months, services continue on a month-to-month or annual
basis and may be cancelled at any time with notice
5. Fees and Payments
You agree to pay all fees associated with: - Brain and Memory Clinic programs - Laboratory testing, genetic testing, supplements, or devices (if chosen)
All fees: - Are disclosed in advance - Are paid out-of-pocket - Are not covered by Medicare or private health insurance

6. Informed Consent
No testing, data collection, or program enrolment occurs without your informed consent.
You may withdraw consent at any time; however, this does not negate contractual payment obligations during the initial 12-month commitment (Pro-Neuro program).
7. Limitation of Liability
To the maximum extent permitted by law: - We do not guarantee outcomes, improvements, or prevention of disease - We are not liable for decisions made based on information provided through our services - Our total liability is limited to the fees paid for services in the preceding 12 months (Pro-Neuro program)
Nothing in these Terms limits rights under Australian Consumer Law.
8. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth
